			<content:encoded><![CDATA[<p>Let me first say this: I think we have some of the best home-builders in the country here in Dallas. I am happy to say I would buy a home hands-down from most of them. In fact, I did and I LOVE my home builder. That said, there are also some who should be flogged. Or water-boarded. (Someday I&#8217;ll tell you about a personal experience I had with one who is,  fortunately, no longer building.)  So score one for Bob and Jane Cull of Mansfield who bought a home from Houston-based Perry Homes in 1996, paid $233,730 hard-earned dollars for the place, and then, as soon as they closed, experienced cracks and other foundation problems. They claim that Perry only applied &#8220;cosmetic fixes&#8221;. (Question: did he spackle the cracks? Just caulk and paint? Did any of the other homes in the neighborhood have similar problems?) A Tarrant County jury awarded them $51 million in damages. All through the legal process everyone agreed that Perry Homes, owned by Bob Perry, who is no relation to Rick Perry, but is probably <a href="http://info.tpj.org/page_view.jsp?pageid=667" target="_self">his largest donor</a>, was liable for repairing the home. <a href="http://blogs.dallasobserver.com/unfairpark/2010/03/david_wins_51_million_in_case.php" target="_self">Here, Robert Wilonsky tells it much better than I can.</a></p>
<p>Yesterday I spoke with a quality Dallas homebuilder who asked to remain anonymous. Here are the implications of what a guy like Bob Perry has done, he said: ruin it for the rest of the lot.</p>
<p>As I reported, <a href="http://dallasdirt.dmagazine.com/2009/05/26/adios-to-the-texas-residential-construction-commission/" target="_self">the Texas Residential Construction Commission (TRCC) </a>has been dismantled, and some home builders think the reason why may be Bob Perry:</p>
<blockquote><p>&#8220;I think his heavy handed efforts were one of the main reasons the TRCC went away  – it was perceived that that agency was nothing more than a shell for the big  builders like Perry. What I really worry about is what kind of damage this does  to the rest of us home builders – if we’re perceived as being flush with cash,  then what’s to stop John and Jane Homebuyer from firing up the trial lawyers and  suing at the first sign of a problem? With the TRCC gone, the potential for that  is significant. That’s not to say that people shouldn’t be able to exercise  their rights – they clearly should – but I foresee that we, as an industry, are  going to face a coming onslaught of blackmail lawsuits. At the end of the day, I  have to ask myself, what would it have cost Perry Homes to fix the problem in  that $250,000 house?? At the *<strong>worst</strong>* they could have bought it back at  full price.  I don’t know any particulars of the case and whether the demands by  the homeowners were unreasonable or if Perry just refused to do what they should  have done, but it seems to me that fixing the problem would have been a lot less  expensive!&#8221;</p></blockquote>
<p>Totally!</p>
<p>Anthony Holm, a spokesman for Perry Homes, told the <a href="http://www.google.com/hostednews/ap/article/ALeqM5ifDre1m6HYYsR3paYkXHemLIfgUwD9E6L9F01" target="_self">Fort Worth Star Telegram</a> the award to Robert and Jane Cull of Mansfield is &#8220;equivalent to every single resident in Texas depositing $2 into the lawyer&#8217;s bank account&#8221;. He said it would be appealed.</p>
<p>The Star Telegram also says Perry has</p>
<blockquote><p>&#8220;given millions of dollars to state and federal candidates. He won the 5-4 Supreme Court ruling in May 2008 to overturn the arbitration award. The nine judges on the all-Republican panel, who overturned two lower-court rulings, had each received contributions totaling more than $260,000 from Perry&#8217;s family.&#8221;</p></blockquote>
<p>Gosh, $260,000 is about the price of the Cull&#8217;s home.</p>
<p>Perry H0mes reported revenues of $420 million in 2002, and I&#8217;m sure made way more than that during the boom. So I don&#8217;t get it. Is this all about Bob Perry&#8217;s ego? Even if the Culls <em>were</em> buyers from hell who just could not be pleased no matter what, how much easier AND CHEAPER!!!!!!! would it have been for this mega million dollar company to just make them happy?</p>
<p>Republicans or Democrats, you want to talk about saving and creating jobs? Then stop the insanity. I agree that lawsuit abuse is killing us. So maybe the answer is to first kill the egos.</p>

But this is a heavy snow, the packing snowman  kind (I know being a Chicago gal) and during the night those weight-laden branches fell, taking power lines down with them. Which is why almost half the city was without power for a long time, may still be. (Fingers  just starting to thaw.) So you can imagine what that<a href="http://www.msnbc.msn.com/id/35363134/ns/local_news-dallasfort_worth_tx/" target="_self"> snow did to wimpy carports</a>. This 14 inches happens about one in a century, so I don&#8217;t know if we need to exactly legislate for heftier carport construction standards.  I, for one, had the best time shoveling our driveway with a hay shovel last night!</p>
<p>Update: Anyone with trees on their property is in trouble. My yard man lives in Duncanville and has a major tree down. I just heard parts of Forest Lane were closed due to a tree falling right in the street. I&#8217;m told Royal Crest looks like a &#8220;war zone&#8221; . The branch pictured here? Down.</p>

			<content:encoded><![CDATA[<p>Toured several new homes in Dallas yesterday, including a new, gorgeous $2.9 million spec home that has no formal living room. According to the architect/designer, Don Caperton, <a href="http://tx.serviceslisted.com/825142-CapertonJohnson.htm">Caperton Johnson</a>, two things are out: formal living rooms and wine cellars. The formal living rooms are considered a waste of space and building dollars. Unsaid but widely known: they also keep the Dallas Design District afloat and serve up to many a Dallas husband heart-attack-sized design bills. Wine rooms are also over-rated, costly to install, a legal nightmare if you have teenagers, and people never end up filling the cellar with all that wine.</p>
<p>They just drink it.</p>
<p>Next thing you know, people will be filling their swimming pools.</p>

The agency was supposed to be a vehicle for consumers to get a fair shake out of builders but&#8230; thanks to the <a href="http://www.wfaa.com/sharedcontent/dws/news/texassouthwest/legislature/stories/DN-trcc_25tex.ART.State.Edition2.4ac0302.html">input of many home builders</a>, that didn&#8217;t happen. For one thing, TRCC ruled that all disputes had to go to mediation, creating a virtual cloak of lawsuit protection for home builders. As one home builder told me last week: wouldn&#8217;t you love it if you were shielded from lawsuits? My concern: if we start suing home builders, will that lead to an increase in building costs? Will that give consumers any real protection? Anyhow, WFAA&#8217;s Byron Harris has done a <a href="http://www.wfaa.com/video/index.html?nvid=365176">ton of great reporting on this issue. </a></p>

			<content:encoded><![CDATA[<p>Though the Legislature&#8217;s Sunset Commission staff declared that the Texas Residential Construction Commission ought to ride off into the sunset,  the <a href="http://www.legis.state.tx.us/tlodocs/81R/billtext/pdf/HB02295H.pdf">House passed legislation</a> to keep the supposedly &#8220;save consumers from bad builders&#8221; agency keep on keeping on until 2015. Prior to  final passage, the House adopted 23 amendments, including one to  eliminate the $250 fee to file for state-sponsored inspection. No kidding:  to even file a complaint against a Texas builder you have to pony up a $250 fee. It also  raised the cap  from $75,000 to $175,000 on what individuals can collect from the newly created  homeowner recovery fund, which serves as a last resort for homeowners who could  not collect damages or get a construction defect repaired. Last March, <a href="http://www.wfaa.com/sharedcontent/dws/news/texassouthwest/legislature/stories/DN-trcc_25tex.ART.State.Edition2.4ac0302.html">Channel 8&#8242;s Byron Harris filed a great story </a>on how lawmakers received hundreds of thousands of dollars from Houston home builder Bob Perry, one of the TRCC&#8217;s biggest <span style="text-decoration: line-through;">designers</span> <span style="text-decoration: line-through;"> </span>supporters. Perry says  he supports the TRCC because it protects consumers from unscrupulous builders, but consumer groups say the agency needs to go bye-bye since it makes already-distraught consumers jump through too many hoops (including an arbitration process and inspections) before they can sue a bad builder. Those hoops, says one realtor, just might have been put in place to encourage inaction.</p>

			<content:encoded><![CDATA[<p>So <a href="http://www.insidetxbiz.com/adminnm/templates/frontpage.asp?articleid=3709&amp;zoneid=1">says the chairman of the National Association of Home Builders</a>, a guy from Oklahoma, who claims that because we have kept our inventory levels in check throughout this economic messola, we will be one step ahead of everyone else when it finally clears. I have written this so much I know you are sick of hearing it &#8212; is anybody in D.C. listening? &#8212; the biggest hurdle we face comes from the credit crunch.</p>
<p>&#8220;Our biggest obstacle is getting financing,&#8221; Ron Connally, president of the Texas Association of Homebuilders said. &#8220;We very well could wake up and see shortages in the housing market by the time this thing sorts itself out.&#8221;</p>
<p>Wow, wouldn&#8217;t that be something. Still keep in mind that loose-goosey lending got us into this mess. And some builders whisper they don&#8217;t think they&#8217;ll ever do another spec home, when you have to have 20 to 40% equity tied in it. Many do say the $8000 tax credit for first time home buyers is getting us out at least with the home buying newbies. But&#8230; &#8220;at least three local builders (Arlington-based Wall Homes, Plano-based Sotherby Homes and Irving-based Choice Homes) have either closed or filed for bankruptcy in the past six months. There are countless numbers of unfinished community developments by these and other builders scattered throughout Dallas, Collin and Tarrant counties.&#8221; Ditto that with unoccupied condominiums. Still, was talking to a Title Company exec last night who reminded me of Las Colinas in the late &#8217;80s &#8212; we thought it was a ghost town. Las Colinas, he told me, is thriving today. All it takes is 20 years!</p>

			<content:encoded><![CDATA[<p>We have people of superior intelligence commenting here on Dallas Dirt. Proof: someone just posted a comment that I think is brilliant and appropriate for Earth Day. Why don&#8217;t electricians wire houses so that, as you walk out the door, you could flip a switch and turn off all electrical outlets? Not only would that save electricity it would prevent potential fires from hair dryers/curling irons/irons/Christmas tree lights left plugged in. Our house is wired as a &#8220;smart house&#8221;, meaning we are able to access electronics (lights, music) from our cell phones or computer. Naturally, I have done it once in nine years. But if I could shut down the juice remotely, I might do it more often.</p>
