The Dallas Real Estate community is obsessed with “Agent Orange” — the name top (competing) agents are calling Eleanor Mowery Sheets, in whispers, at lunch, in voicemails and over the water coolers. The IRS has accused Eleanor and her husband, Nicky, of not paying Uncle Sam’s fair share. Now inquiring minds want to know why all of Eleanor’s listings have been placed under Nicky’s name. Indeed, if you check the TREC website, you will see that Eleanor’s license (under the name Eleanor Fisher Mowery) is inactive but does not expire until 6/30/2010. According to the couple’s spokesperson, Keith Nix, Eleanor is in the process of having her license renewed — she just had such a busy spring she didn’t get around to getting a more “elaborate proof of personal identification than in years past” — a new TREC requirement since January 1, 2008. (A call to the TREC just confirmed that “more elaborate proof” has not yet been processed.) The listings are in Nicky’s name temporarily, he said. Not one of their listing signs has come up, say Keith, and in fact they just closed a big deal and had six open houses Sunday with great traffic. In other words, business as usual and brisk. Steve Brown: the Sheets have no immediate plans to sell their home on Lakehurst, at this point, says Keith. (Maybe they’ll join the other high profile Realtors residing at the Crestpark?) As far as the IRS problemos, Keith says Nicky and Eleanor have fulfilled their obligation to the IRS on every other decision that’s been made and IF they owe money, they will pay it. As far as the $230,875.75 owed in employment taxes the Sheets allegedly owe, the feds are VERY picky about paying this tax to the point that they can even hold a bank responsible for a clients’ employment taxes in some cases since they are withheld by employers from employee’s paychecks. Keith says he can only think of two employees in the office that would be affected by those taxes, a photographer and a receptionist, who happens to be Eleanor’s daughter. (Most Realtors work as Independant Contractors and pay their own taxes.)
The listings were transferred to Nicky on 7/28/08, just right before the suit was filed. Keith Nix is blowin’ smoke…
Now this particular listing is shown to have been closed by Eleanor on 8/1/08.
If this is true and the checks were paid to Eleanor and she was paid and did not have an “active” license then Coldwell Banker could be in trouble as the Broker paying a non licensed person.

So are you saying they had prior knowledge of the suit being filed?
If they are such goody-two-shoes, why have they had so many IRS prroblemos – apparently, this isn’t the first. Do you think Mr. Nix is getting paid in advance? Or will he be yet another screwed vendor? He has certainly been working overtime.
I wouldn’t doubt that they had prior knowledge of the suit being filed. This has been going on for years. I don’t believe it was a complete surprise to them. The suit was filed as a last resort….the government is tired of playing games.

Keith Nix is part of the team and is obviously doing the deflection for them. He is the only supplier that they pay. I am so tired of all of these lies.
Yeah, I wonder if Mr. Nix realizes that his reputation is going down the drain with the Sheets? I don’t think the DMN was very happy being used with that Hunt home article that Keith apparently misled them on. At what point does a PR person go over the line and leave their ethics behind?
I would assume Mr. Nix is getting paid, but we know other vendors aren’t. If he is the person who hires the other vendors, does he do so knowing EMS won’t pay? If that’s the case, then that is pretty shameful, and his rep will definitely be tarnished after this whole thing is over.
I am one of the vendors, obviously, and know of several others that are owed. Keith was directly involved in hiring all of us and he directed the billing to Nicky. I don’t think he has any other options, I can’t imagine any other realtor embracing him right now.
I would be surprised if these vendors would do work for Keith in the future for ANY of his clients. I mean, if he knew that the Sheets’ didn’t pay their bills, yet he continued to go out and hire people to do work – how trustworthy can he be? There’s a difference between trying to get good PR for a client, doing damage control, etc. (which is a PR guy’s job) vs. hiring vendors knowing they were going to get screwed. That’s not a reputable way to do business. I guess working for EMS has rubbed off on him or something.
